Privacy Policy

FITSY Sp. z o. o. takes special care to protect your privacy. In this document, we provide you with information regarding our policies for collecting, processing and using information about Users of our Services. This Privacy Policy applies to all of our Services, unless stated otherwise.

Before using our Services, please read the Terms of Service ("Terms"), which describe the terms under which Users use our FITSY application.

I. The administrator

The administrator of your data, including personal data, is - FITSY Sp. z o. o. , registered at ul. Michałowicza 12, in Bielsko-Biała, registered under KRS 0000853348, REGON 386695278, NIP 5472220088.

II. Collected informations

In order to provide, improve, learn about, personalize, support and sell our Services, including when Users install, use and access our Services, FITSY must receive and collect certain information. The types of information we receive and collect depend on how you use our Services.

A) Informations provided by users

User Account Information. To create an account it is necessary to provide your name and e-mail address. In addition, the User may add his/her last name, phone number, date of birth, gender and fill in the public profile fields: city, state, "about me" information, as well as include links (links) to social media (e. g. , "social media"). Facebook, Instagram), websites.

Clients and groups. You can create, join or be added to customer groups or contact lists, and such groups and lists will be associated with your account information. You give the groups names. You can add a profile picture or description to the group. In addition, you give us yours or your clients' physical characteristics, weight, muscle circuits, training achievements and other data related to the fulfilment of the training and nutrition plan. This information will be stored on our servers for up to 30 days after your account is deleted. If legal disputes arise, we may extend the time we keep your information until the legal proceedings are completed.

Exercises, Workouts and Programs. A workout, nutrition, program or exercise plan created by you or modified from a general template or from another User may be stored by us indefinitely.

Calendar. For the security of App Users, we store the data and dates stored in the App calendar(s) on our servers.

Your messages. We do not collect your messages in the normal course of providing the Services. Once delivered, messages (including chats, photos, videos, voice messages, files, and location information) are deleted from our servers. Users' messages are stored on their own devices. If you are unable to deliver your message immediately (for example, if you are offline), we may store it on our servers for up to 30 days in an effort to deliver it. If after 30 days we still haven't managed to deliver the message, we delete it. We may also retain this content on our servers for an extended period of time in order to streamline operations and deliver multimedia messages more efficiently, such as when a lot of people share a popular photo or video.

Customer Service. You may provide us with information related to your use of our services, including copies of your messages and information about how to contact you so that we can offer our services to you as a customer. For example, you can send us an email with information about the performance of our application or other problems.

B) Information collected automatically

Usage information and log records. We collect information about your activity on our Services, e.g. information about services, diagnostics and information about their effectiveness. This includes information about your activity (including information about how you use our Services, your Service settings, information about how you interact with others through our Services, and data about the time, frequency, duration of your activities and interactions), log files and crash logs, website and activity logs and reports. This also includes information about when you registered for our Services, information about the features you use, e. g. messages, conversations, status or group features, profile picture, information about yourself, information about whether you are online, when you last used our Services, when you last updated your information about yourself.

Device and connection information. We collect device and connection information when you install, access or use our Services. This includes: device model, operating system information, battery level, signal strength, application version, browser and mobile network information, connection information including phone number, carrier or ISP name, language and time zone, IP address, device operations information, and identifiers such as device ID (including identifiers unique to Facebook Company Products associated with the same device or account).

Cookies. We use cookies to provide our Services, including to provide online services, improve your use of our Services, learn about your use of our Services, and customize our Services. We may also use cookies to show you relevant content related to our Services. We may also use cookies to remember your choices, i. e. language preferences, to provide a safer way to use the Services, and to customize our Services to your individual needs.

III. How we use the information

We use the information we have (subject to your choices) to operate, provide, improve, understand, customize, support and sell our Services.

Our Services. We use the information we have to provide our Services, including customer service and to improve, repair and adjust our Services. We learn about how you use our Services and analyze and use the information we have to evaluate and improve our Services, to research, develop and test new Services and features, and to conduct troubleshooting activities. We also use them to respond to your contact requests.

Safety. We verify user accounts and activities, improve and promote security both inside and outside our Services, for example, by investigating suspicious activities and violations of our policies and Terms of Use and to ensure that our Services are used lawfully.

Measurement, analytical and other business services. We may help companies using FITSY applications to measure the effectiveness and distribution of services and messages and to understand how users interact with our Services.

IV. Shared informations

Sending your data to the people you want to communicate with. You share your data (including messages) as you use and communicate through our Services.

Account information. Information such as name, city, state, social media links and website links are visible to other FITSY App Users. In the application settings, you can configure (e. g. limit) setting up your Services to manage certain information available to other Users with whom you communicate.

Your contacts and others. Users with whom you communicate may store or re-share information about you with others on and off our Services. In the Services settings, you can block a specific feature on our Services to restrict access to your information that you share.

FITSY business partners. Because the FITSY app is largely free, we are free to help companies using our app measure the effectiveness and distribution of services and messages and understand how users interact with our Services.

Third party service providers. We work with third-party service providers and Companies owned by Google and Apple to help provide, improve, analyze, customize, support and market our Services.

V. Assignment, change of control and transfer of rights

All of our rights and obligations under the Privacy Policy may be freely transferred by us to any of our affiliates in connection with a merger, acquisition, restructuring, sale of assets or by operation of law or otherwise; and we may transfer your information to any of our affiliates, successors or new owners in connection therewith.

VI. User Data Protection

Under the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, also known as RODO), you have the right to:

  1. to access your data,
  2. to rectify them,
  3. to transmit or erase that data,
  4. to express objection to specific forms of processing, as well as to imposing restrictions in this regard and to object. This includes the right to object to our processing of your data for direct marketing purposes and the right to object to processing in areas where we are acting in the public interest, our own legitimate interests or those of third parties,
  5. to withdraw the consent you have given at any time. However, withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before it’s withdrawal.

You can access the tools we provide to correct, update, or delete information directly in the application, as described in the "Managing and Deleting Information" section. If we process your information on the basis of our legitimate interests or those of a third party or in the public interest, you may object to such processing, in which case we will cease processing your information unless there are valid legal grounds for such processing or unless it is necessary for a legal purpose. You can also object to us processing your data.

In case when we use your information for direct marketing of our own Services, you can always object and opt-out of receiving future marketing messages by using the unsubscribe link included in such messages or by using the "Block" feature inside the app. If you do not agree to this, we reserve the right to delete your account. In this case, if the User used the paid version of the application, the remaining amount paid is not refundable.

The data protection rights mentioned in this paragraph apply globally, also outside the European Union.

VII. Information management and deletion

We retain information for as long as necessary in connection with the provision of the Services (minimum period is 30 days from the date you delete your account), whichever comes first. This is determined on a case-by-case basis and depends on issues such as the nature of the information, the reason for collecting and processing it, and relevant laws or operational needs.

If you want to manage, change, restrict or delete your information, we allow you to do so with the following tools:

Service Settings. You can change your Services settings to manage certain information available to other users, including account, contacts, groups, workout plans, nutrition plans and calendar. You can use the blocking feature to restrict access to your data that you do not wish to disclose to other Users.

Change your name, email address and information about yourself. You can change your name and email address using a special function available in the application. You can change other information about yourself at any time, including links to social media and your website.

Deleting a FITSY account. You can delete your FITSY account at any time (including revoking your consent to the use and processing of your information). When you delete your FITSY account, undelivered messages will be deleted from our servers, as will any other information we no longer need to operate and provide our Services. Please note that if you just delete our Services from your device without using the in-app account deletion feature, your data may be stored by us for an extended period of time. We remind you that deleting your account does not affect any information related to you that other users have, e. g. copies of messages you send them, comments, or other interactions. Unless they are in violation of the Rules and Regulations and you report it to us.
In order to remove your account data please go to the app settings screen and tap on "Remove account data" it will then send a request which you will have to confirm afterwards. After that you will be logged out and your data removed. Another way is to contact us via support@fitsyapp.com email and send us your email which you used to login.

VIII. Law and protection

We collect, use, retain, and share information when we reasonably believe it is necessary to (a) respond, in accordance with applicable laws and regulations, to a legal action or request from a governmental authority; (b) implement our Terms and Conditions and other applicable laws and policies, including investigating potential violations; (c) detect, investigate, or prevent fraud and other unlawful activity or technical problems; or (d) protect the rights, property, and safety of our users, FITSY, our business partners, or others, including to prevent death or serious bodily injury.

FITSY Sp. z o. o. may exchange information globally, with our partners and with entities around the world with whom you interact and to whom you share information in accordance with this Privacy Policy. Information may be given or transferred to or stored or processed in the United States or other countries outside of your residence solely for the purposes described in this Privacy Policy. Such data transfers are necessary to provide the Services as set forth in the Terms of Service and to operate globally and provide the Services to users.

IX. Access to necessary information

The FITSY application actively uses the possibilities offered by current mobile devices during its operation. To ensure proper operation of the FITSY application, upon installation or the first time you use an application feature that uses a particular module on your phone, you will be asked to agree to:

In case of addition or modification of FITSY app features that require access to previously unapproved modules on your phone, the app will ask you to approve the extended permissions.

X. Other

In case of personal data protection, the User has the right to lodge a complaint to the Polish Office of Personal Data Protection.

We will notify you by separate message before we make changes to this Privacy Policy, giving you the opportunity to review the new version before you decide to continue using our Services.

By installing or using the FITSY application, you agree to the contents of this Privacy Policy. Otherwise, please do not agree to the installation or uninstall the application.
